Section 1Who We Are

Ormonde Benefits Administration LLC (“Ormonde Benefits Administration LLC,” “OBA,” “we,” “us,” or “our”) is a Texas-licensed Third-Party Administrator (License No. 3392865) headquartered at 4100 Alpha Road, Suite 500, Dallas, Texas 75244. We administer the Paydcash™ healthcare benefit program on behalf of plan sponsors, distributors, and members.

Section 2Scope of This Notice

This Privacy Notice applies to information Ormonde Benefits Administration LLC collects:

  • When you visit our website at paydcash.com or any subdomain we operate;
  • When you contact us by email, phone, text message, or postal mail;
  • When you (or a plan in which you participate) provide information to us in connection with the Paydcash™ program;
  • When we receive information from plan sponsors, distributors, business partners, regulators, or service providers in connection with our administration of the Paydcash™ program.

Information that Ormonde Benefits Administration LLC receives, creates, or maintains as a Business Associate on behalf of a covered health plan is also governed by the Health Insurance Portability and Accountability Act of 1996, as amended (“HIPAA”), and the Business Associate Agreement with the applicable plan. Where HIPAA applies, the more protective rule governs.

Section 3Information We Collect

The categories of information we may collect about you include:

3.1 Information You Provide Directly

  • Contact information — name, postal address, email address, telephone number.
  • Member identifiers — health plan member ID, date of birth, last four digits of Social Security number where collected for verification.
  • Eligibility and enrollment information — coverage status, dependents, employer/plan sponsor information.
  • Financial information — payment method information limited to what is needed to fund or transact on the Paydcash™ card.
  • Authorization and consent records — signatures, attestations, and authorizations you provide.
  • Inquiries and correspondence — the content of any messages or forms you send us.

3.2 Information We Receive From Others

  • From your health plan or plan sponsor — eligibility, enrollment, and benefit information.
  • From Paydhealth, LLC (the distributor of Paydcash™) — enrollment, identity, and transaction information.
  • From healthcare providers, pharmacies, and laboratories that have provided services to or for you, where authorized.
  • From our service providers, banking partners, and Ormonde Investment Management, LLC.
  • From regulators and other governmental authorities, where required by law.

3.3 Information Collected Automatically From the Website

  • Device and browser information (e.g., IP address, browser type, operating system, referring URL);
  • Usage information (e.g., pages viewed, time on page, links clicked);
  • Aggregate analytics signals, as further described in Section 10.

Section 4How We Use Your Information

Ormonde Benefits Administration LLC uses the information we collect for the following purposes:

  • To administer the Paydcash™ healthcare benefit program, including eligibility, enrollment, card issuance, funding, transaction adjudication, and recordkeeping;
  • To verify your identity and prevent fraud, money laundering, and other unlawful activity;
  • To respond to your inquiries and provide customer service;
  • To communicate with you about your account, eligibility, and the program (including by phone, text, email, and postal mail as permitted by applicable law);
  • To comply with our legal, regulatory, and contractual obligations (including applicable federal and state third-party administrator reporting, ERISA, HIPAA, the Gramm-Leach-Bliley Act, and applicable anti-money-laundering rules);
  • To produce de-identified or aggregated data that does not reasonably identify you for analytics, reporting, and program improvement;
  • To operate, maintain, and secure our website and information systems;
  • For any other purpose disclosed to you at the time of collection or for which you have provided consent.

Section 5How We Share Your Information

Ormonde Benefits Administration LLC does not sell your personal information. We share information only as described below.

  • With your health plan and plan sponsor — for eligibility, enrollment, benefit administration, and reporting.
  • With Paydhealth, LLC — as the distributor of the Paydcash™ program.
  • With Ormonde Investment Management, LLC (OIM) — in connection with investment services OIM provides to plan sponsor clients of the Paydcash™ program. OIM does not provide investment services to the program itself or to individual plan participants.
  • With service providers — banking, card issuing, payment processing, IT, security, mailing, document storage, and similar vendors operating on our behalf under contractual confidentiality obligations.
  • With healthcare providers, facilities, pharmacies, ancillary healthcare facilities, and manufacturers of relevant reimbursable products — where authorized by you or as necessary to administer benefits.
  • With regulators and authorities — including the Texas Department of Insurance and other regulators, in response to a lawful request, subpoena, court order, or other legal process.
  • To protect rights and safety — where we believe disclosure is necessary to prevent fraud, investigate suspected illegal activity, or protect the rights, property, or safety of any person.
  • In a corporate transaction — in connection with a merger, acquisition, financing, or sale of all or part of our business, subject to applicable confidentiality and privacy protections.

Section 6HIPAA & Protected Health Information

When Ormonde Benefits Administration LLC handles Protected Health Information (“PHI”) as a Business Associate of a covered health plan, our use and disclosure of that PHI is governed by HIPAA, the Privacy and Security Rules, and the Business Associate Agreement we have entered into with the plan.

Your HIPAA Rights. Members have specific rights under HIPAA, including the right to access their PHI, request amendments, receive an accounting of certain disclosures, request restrictions on uses and disclosures, request confidential communications, and file a complaint without retaliation. These rights are administered through your health plan’s Notice of Privacy Practices. Please contact your plan directly to exercise your HIPAA rights. We will assist your plan in fulfilling such requests as required by our Business Associate Agreement.

Section 7Data Security

Ormonde Benefits Administration LLC maintains administrative, technical, and physical safeguards designed to protect the confidentiality, integrity, and availability of the information we hold. These measures include encryption in transit and at rest where appropriate, role-based access controls, vendor due diligence, employee training, security monitoring, and incident response procedures designed to meet or exceed HIPAA Security Rule standards and applicable federal and state data security requirements.

No method of transmission over the internet or electronic storage is 100% secure. While we strive to use reasonable means to protect your information, we cannot guarantee absolute security.

Section 8Your Rights & Choices

Depending on the information at issue and the law that applies, you may have the right to:

  • Request access to, or a copy of, information we hold about you;
  • Request correction of inaccurate or incomplete information;
  • Withdraw a previously granted consent or authorization (without affecting the lawfulness of prior processing);
  • Opt out of certain marketing communications — you can unsubscribe via the link in any marketing email or by contacting us;
  • Request that your information be deleted, subject to record-retention requirements imposed by HIPAA, ERISA, applicable federal and state third-party administrator regulations, and other applicable law.
  • Text messaging originator opt-in data and consent will not be shared with any third parties, excluding aggregators and providers of the Text Message services.

To exercise any of these rights, please contact us using the information in Section 16. We may need to verify your identity before responding to your request.

Section 9SMS Privacy Rights

SMS Terms and Conditions

The Paydcash program provides a payment platform that provides HSA and HRA administration services designed to help you settle cash or self-pay purchases for your eligible healthcare expenses. By opting in to SMS services offered under the program, you will receive notifications of upcoming events, updates required by your plan, enrollment requests, and any ongoing event updates via SMS according to your selection.

You can cancel the SMS service at any time. Just text “STOP” to the short code. After you send the SMS message “STOP” to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, simply sign up as you did the first time and we will start sending SMS messages to you again.

Carriers are not liable for delayed or undelivered messages.

As always, message and data rates may apply for any messages sent to you from us and to us from you. Message frequency varies. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

Section 10Cookies, Analytics & Tracking

Our website does not use cookies. We use a privacy-preserving third-party analytics service (currently Fathom Analytics) to understand aggregate site usage. Fathom does not use cookies, does not fingerprint visitors, does not track individuals across sites or sessions, and does not collect personal information. The analytics service processes information on our behalf under contractual confidentiality obligations and collects only aggregate signals such as page views, referring source, browser type, and country (derived from IP address, which the service does not retain). We do not use cookies, similar technologies, or profiling for cross-context behavioral or targeted advertising.

Section 11Children’s Privacy

Our website and services are intended for individuals 18 years of age and older, or, in the case of dependent members of a covered plan, for use by a parent or legal guardian on their behalf. We do not knowingly collect personal information directly from children under 13. If we become aware that we have inadvertently collected such information, we will delete it promptly.

Section 12State-Specific Disclosures

Although Ormonde Benefits Administration LLC is headquartered in Texas, we administer the Paydcash™ program for plan sponsors and members located in multiple states. Where we act as a third-party administrator in a given state, we comply with that state’s third-party administrator licensing and insurance laws and its requirements for safeguarding personal and health information. For employer-sponsored plans that are governed by the Employee Retirement Income Security Act of 1974 (“ERISA”), our handling of plan information is also subject to applicable federal law. The disclosures below describe rights that may apply depending on the state in which you reside.

12.1 Texas Residents

As a Texas-licensed Third-Party Administrator, Ormonde Benefits Administration LLC complies with applicable provisions of the Texas Insurance Code and the regulations of the Texas Department of Insurance governing the protection of personal and health information.

12.2 Washington Residents — My Health My Data Act

If you are a Washington resident, the Washington My Health My Data Act (RCW 19.373) provides you with additional rights over your consumer health data. This section supplements the rest of this Privacy Notice to address those requirements. Data that OBA maintains solely as a HIPAA Business Associate is exempt from the MHMDA and remains governed by HIPAA and the applicable plan’s Notice of Privacy Practices.

OBA does not sell consumer health data.

Federal law (including ERISA and Internal Revenue Code rules) requires us to retain certain health benefit plan records for up to seven years. We cannot delete records while we are legally required to keep them; where this applies, we will inform you and delete the data once retention is no longer required. We will respond to any request within 45 days, with one 45-day extension where reasonably necessary. We will not apply a material change to this Privacy Notice to consumer health data already collected without first obtaining your consent. We will not retaliate against you for exercising your rights.

If you are not satisfied with our response, you may contact the Washington State Attorney General’s Office, Consumer Protection Division, at atg.wa.gov or 1-800-551-4636.

12.3 Residents of Other States Where We Administer Benefits

For residents of states other than Texas, Ormonde Benefits Administration LLC complies with the third-party administrator, insurance, and information-protection laws of each state in which it is licensed or registered and conducts business. Where a state imposes requirements that are more protective than those described elsewhere in this Notice, we will honor the more protective requirement to the extent it applies to our processing.

12.4 California Residents

To the extent the California Consumer Privacy Act, as amended by the California Privacy Rights Act (“CCPA/CPRA”), applies to information we collect from California residents that is not otherwise exempt as PHI or financial information regulated by HIPAA or the Gramm-Leach-Bliley Act, California residents may exercise the rights to know, delete, correct, and limit certain uses, subject to verification and statutory exceptions.

12.5 Residents of Other States With Comprehensive Privacy Laws

Residents of other states with comprehensive consumer privacy laws (including, where applicable, Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, and others) may have rights to access, correct, delete, and obtain a copy of certain personal data, and to opt out of certain processing. To the extent these laws apply and our processing is not exempt (for example, as a HIPAA-regulated or Gramm-Leach-Bliley-regulated activity, or as data processed on behalf of an ERISA plan), we will honor the rights you have under your state’s law, subject to verification and statutory exceptions.

12.6 ERISA Plans

Where we receive, create, or maintain information as a service provider or Business Associate of an employer-sponsored group health plan governed by ERISA, our use and disclosure of that information is also subject to ERISA, HIPAA, and our agreement with the plan. Plan participants should direct requests concerning their plan information to the plan administrator identified in their plan documents; we will assist the plan as required by our agreement and applicable law.

Section 13Third-Party Links & Services

Our website may contain links to third-party websites and services that we do not own or control, including external map providers, partner sites, and analytics services. This Privacy Notice does not apply to those third-party services. We encourage you to review their privacy notices before providing information to them.

Section 14International Visitors

Ormonde Benefits Administration LLC operates from the United States. If you access the website from outside the United States, you understand that your information may be transferred to, stored in, and processed in the United States, where data protection laws may differ from those of your country.

Section 15Changes to This Notice

We may update this Privacy Notice from time to time. We will post the updated notice on this page with a revised “Last Updated” date. If we make material changes, we will provide additional notice as required by applicable law.
